Government Commits to Stop Aggressive Enforcement of Fresh Milk Regulations Pending Constitutional Challenge
Counsel for the Fraser Health Authority committed to the British Columbia Supreme Court to refrain from taking enforcement action against Fresh Milk cowshares pending the determination of a constitutional challenge initiated by Alice Jongerden and Home on the Range cowshare.
The government commitment is welcomed by Alice Jongerden. “The government’s commitment to back away from aggressive prosecutions is a relief for us. We now have some breathing room while the Courts determine whether Canadians have a right to choose between whole and processed foods.”
The official commitment came during an administrative Court hearing to clarify the type of process Ms. Jongerden can use to challenge s.7 of the Public Health Act Transitional Regulation, which deems Fresh Milk to be a public health hazard. There have been no reported adverse health consquences demonstrated to be caused by Fresh Milk in the Province of British Columbia within the past 50 years
