“Durham area raw milk producer Michael Schmidt has received two injunction notices from York Region and the Attorney General on behalf of the Ministry of Agriculture and Rural affairs.
Schmidt says the blanket injunctions name himself, his wife and son — as well as any “John Doe” producing and distributing raw milk in Ontario.
He says it would basically make it a crime for any farmer in the province to hand over raw milk to a neighbour and he plans to fight the injunctions in a Newmarket court March 16th.
Michael Schmidt has been fighting for the right to distribute raw milk for roughly 2 decades and says it feels like “the final standoff has begun.”…”

I don’t know the details; but if I may suggest….
the only way to approach this, is Michael and others doing themselves without a lawyer, making a claim of injury against those involved, and asking them to provide evidence as to how it is they came to the conclusion that Michael is in some way guilty of breaking the law. Whats their cause of action? They don’t one! Its all presumption!!!
If its illegal to do something, then there must be a paper trail providing such evidence. If something is unlawful- show me an injured party!
Legal implies a contractual obligation by way of consent. If Michael is an employee, agent or officer of Her Majesty then it would only be by consent. And all Agents, officers and employees of Her Majesty are required to comply with the rules and regulations of the province.
Is Michael a Public Servant???
As a “free inhabitant” who lives in the United States of America I am inspired to search for the “organic laws” of Canada to learn whether Canada also has ever acknowledged the status of Canadian-born
individuals to be free of external government control just as the Articles of
Confederation (1777) do.

I will try to get to the Newmarket court, but Wednesday is the only day I have to work, so may not make it, however I am more than willing to sign an affidavit for the court. I want to be able to buy raw dairy legally. I need it for myself my dogs and my livestock and it is a problem for me to consume pasteurized as I am intolerant of it and it is not healthy for the dogs or the livestock.
According to Michael, these injunctions are at this point merely proposals, and they would need the approval of a court to be put into effect. Currently they are scheduled to be brought before the court in March of 2016.
The application for an injunction pertains to ARC/Glencolten farms only. It does not apply to other operations. Insinuating that it does apply to other farms/operations is completely misleading (hyperbole)! Such misleading remarks leave other producers feeling like they will also be the subject of the injunction. Suggesting that it does is effective at spurring them on (politically) and justifies the demand for more cash support from everybody.
Considering the grounds for the application, I can’t see that even an expensive lawyer will get him/them off. The class action law suit is good political fodder, but I’d be willing to predict that the only winners will be the lawyers. It’s kind of like Stephen Harper’s many court battles, which he lost. It portrayed an image of “fighting for his supporters”, but in the end they were very expensive for the taxpayers.
IMO, as part of making an informed decision, people would do well to read the Notice of Application for themselves…

You don’t beg your slave master for your rights, you just go ahead and exercise them. Let them try to put the thousands into jail that would be necessary if everyone just ignored their tyranny. We can defeat any of this tyranny overnight, all it takes is for men to grow backbones.
