Another look at the laws about raw milk

Contrasting Ontario Laws and Acts about Raw Milk in Courts with other Major Jurisdictions (Part 2)

I – Introduction :

Last week we listed some of the major acts, laws and regulations being cited by Crown Lawyers in the latest manifestions, in the form of the 2 applications listed below, in the never-ending case(s) against Organic Raw Milk and its adherents, consumers, supporters, co-op members, farmers and producers in Ontario and Canada. For brevity’s sake we gave only the relevant sections from the Ontario Milk Act and Milk Regulations to begin with .

We then observed, in Newmarket Court, the Crown Lawyers for Gavin Downing, director for the Milk Act, and the York Region Municipality, systematically work through all of those major acts, one by one in great detail, stating first which sections were violated, what they say and mean, and then the evidence (from myriad affidavits, discovery and testimony) to support their claims of violation, and punishment(s) sought.

In addition to all the Acts and Regulations listed last week and again today, the Crown’s Legal team consisting of 4-5 lawyers, also cited 6-10 examples of Case Law which we will not list here. Of interest was the fact that they cited case law from England to justify the enforcement of certain bureaucratic regulations, and the need for concomitant restraining orders where they have been continually violated.

The SUPREME IRONY here is that they failed to cite the most important Laws and Statutes of all , from the United Kingdom , namely that Fresh, Organic Raw Milk from Grass-fed cows is 100% legal and freely available from Her Majesty the Queen’s homeland . B.C. Raw Milk Negotiations Underway

Advocating for the Herdshare Community — A Progress Report

Before BCHA was founded in June 2014, the raw milk community was surveyed to find out what services members wanted their new organization to provide. The answer was Support, Education, and Advocacy.

In July 2014, BCHA started its Advocacy program, to initiate dialogue with decision-makers about changing the laws, which make raw milk illegal in B.C. In July 2014, we wrote to Minister of Health Dr. Terry Lake: “We would like to request 10 minutes of your time, at your convenience, to discuss some ideas we would like to present for renewing and updating the regulation of unprocessed milk and dairy products. Our organization would like to talk about ways in which this safe, healthy, nutritious product could be provided legally to those consumers who wish to access it.”

In August 2014, a staff person responded, stating that the Minister was going to be extremely busy over the next few months, and a meeting wasn’t possible “at this time.” We asked if there were others in the Ministry who might be available, and a meeting took place in November 2014 with an assistant deputy minister and an executive director, to establish a dialogue where none had existed before. BC E-coli case tied to raw milk cheese

“With one person dead and 10 ill, others who ate cheese from an artisan dairy in Salmon Arm are nervous.

While investigators try to pin down the cause of a fatal E. coli outbreak at the dairy, Iain Ilich is wondering whether he, his wife and 13-month-old daughter are going to fall ill.

Ilich purchased several cheeses at Gort’s Gouda Cheese Farm while travelling through the Interior about a month ago.

“I’ve got some smoked Gouda, peppercorn Gouda and Gouda with cumin seed in the fridge,” said Ilich, a communications specialist in Calgary. “I’ve eaten it, my dad has eaten it and I’m particularly concerned because my wife and my daughter have eaten it as well.” Continue reading

A: Introduction

Building on the theme of collaboration and synergy, in the work of food security,  anti-GMO awareness and public education, through the examples of interviews (Vandana Shiva May 1, 2013), writings (Dr. Thierry Vrain’s May 23 GMO Dangers essay), podcasts, activism and rallies, I continue this process with a summary about the recent June 5 “Community Forum on GM Food” and lecture by retired GM Scientist Dr.Thierry Vrain  in Surrey BC that was sponsored by Phil Harrison, the Council of Canadians ( www.canadians.org ) and others.

Michael Schmidt and Gordon Watson convicted of contempt of court in BC “Home on the Range” raw milk case

Ontario raw milk advocate Michael Schmidt and BC raw milk pioneer Gordon Watson were found guilty today, on charges of contempt, by Mr. Justice Wong of the B.C. Supreme Court. The charges relate to an order dating from March 18, 2010, given to former “Home on the Range” cowshare farm agister Alice Jongerden to cease and desist the farm’s raw milk operations.

Subsequent to this order, Michael Schmidt was said to have taken over as agister of the farm which was reconstituted as “Our Cows”, the products of which were labeled as cosmetics and “not for human consumption”. In his judgement, Justice Wong said: Continue reading
